Terms and Conditions
Tax Information: Any tax, duty, custom or other fee of any nature imposed upon the products, their sale, transportation, delivery, use or consumption shall be paid by Buyer in addition to the price quoted or invoiced. If EasyPC Store.com, Easy PC Solutions LLC or its affiliates are required to prepay any such tax or fee, Buyer will reimburse EasyPC Store. Buyer must provide Easy PC Solutions with a resale/exemption certificate in order to avoid the withholding of applicable taxes. No refund or adjustment to previously withheld taxes will be made by Easy PC Solution LLC sixty (60) days after the invoice date. Proof of certification should be mailed to: Easy PC Solutions LLC., 2312 Grandview Blvd. Suite 100, Waukesha, WI 53188, or faxed to (262) 542.0128.
Software: All software is provided subject to a license agreement and you agree that you will be bound by such license agreement in addition to these terms. Title to software remains with the applicable licensor(s). McKessen software will be registered to the listed purchaser on the invoice.
Remote Installation: Easy PC Solutions LLC will be glad to assist you with the installation of your new products using a remote computer connection. Using this service, you hereby agree to allow Easy PC Solutions LLC to act upon your behalf to accept the End-User License Agreement or EULA for the software being installed. You understand that by accepting the EULA you will limit your rights. You will be agreeing to hold harmless the software licensor in the event that the software causes damage to the user's computer or data. Other conditions may include; but not limited to, includes limitations on whether the licensor can be held liable for damage that arises through improper use of the software (for example, incorrectly using tax preparation software and incurring penalties as a result).
Not For Resale or Export: You agree to comply with all applicable laws and regulations of the various states and of the United States. You agree and represent that you are buying for your own internal use only, and not for resale or export.
Damage or Loss in Transit: Identity of items and extent of damage or loss must be noted on Buyer's copy of delivery document by the agent of the transportation company. If damage is discovered after receipt of shipment, Easy PC Solutions LLC must be notified with in three (3) days of receipt. Easy PC Solutions LLC will replace or refund (under our sole discretion) any damaged product.
Warrantee and Guarantees: Easy PC Solutions LLC and its affiliates imply no warranties for any product. Warranties are based upon manufactures’ representations. Easy PC Solutions and its affiliates will be glad to assist clients with their product warranties. Charges may apply for warrantee repairs.
Governing Law:THE PARTIES AGREE THAT THIS AGREEMENT, ANY SALES THERE UNDER, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, AND EQUITABLE CLAIMS) BETWEEN Client AND EASY PC SOLUTIONS LLC AND ITS AFFILIATES ARISING FROM OR RELATING TO THIS AGREEMENT, ITS INTERPRETATION, OR THE BREACH, TERMINATION OR VALIDITY THEREOF, THE RELATIONSHIPS WHICH RESULT FROM THIS AGREEMENT, EASY PC Solutions LLC ADVERTISING, OR RELATED PURCHASE SHALL BE GOVERNED BY THE LAWS OF THE STATE OF WISCONSIN, WITHOUT REGARD TO CONFLICTS OF LAW.
Continuance: This agreement applies to all future purchases of products and services EasyPC Store.com, Easy PC Solutions LLC or its affiliates, unless a notice is provided by the Buyer prior to any purchase objecting to this agreement.
Changes: Easy PC Solutions LLC reserves the right to change the terms and conditions agreement upon notice.
